Terms of Service

Nivera simulates how audiences might react to ad creatives, offers and landing or checkout pages, using synthetic personas built from aggregate public data. It produces predictions, rankings and explanations to help you decide what to launch. We may add, change or remove features; we will give reasonable notice of changes that materially reduce what a paid plan includes.

• You must be 18 or older and give accurate details. You are responsible for activity under your account and for keeping your password safe.
• Workspace owners control who joins their workspace and are responsible for their members' use of it.
• One person may hold more than one workspace, but creating accounts to obtain extra free previews is not allowed and we may merge or close such accounts.

• Free previews: each account gets a limited number of free previews per month on a small persona sample. Previews show part of the results; the full report requires credits.
• Credits pay for full tests. The exact number a test will use is shown before you launch it. Credits reserved for an optional deep check are returned if it isn't needed, and credits for a run that fails on our side are returned automatically.
• Plans renew automatically each billing period until cancelled and include a monthly credit allowance. [Unused plan credits: expire at the end of each period / roll over for up to N months.] Pay-as-you-go credits [expire 12 months after purchase].
• Payments are processed by our payment provider, Dodo Payments, which may act as merchant of record and handle taxes and invoices. Prices are shown before purchase and may change for future billing periods with notice.
• Cancellation and refunds: you can cancel a plan at any time; it stays active until the end of the paid period. Except where the law requires otherwise or as stated above, payments and used credits are non-refundable.

• You keep all rights to the creatives, copy, pages and data you submit (“Your Content”). You give us a limited licence to host, process and analyse it — including with the AI providers named in the Privacy Policy — only to provide the Service to you.
• We do not use Your Content to train shared models unless you opt in.
• You confirm you have the rights and permissions needed to submit Your Content and that it does not infringe anyone else's rights.
• Results, reports and recommendations generated for you are yours to use. The Service itself, our persona banks, models and software remain ours.

• Only submit pages you own or are authorised to test. Walk-throughs of carts and checkouts only run on domains you have verified, and always stop before payment — no orders are placed and no payment details are entered.
• Our crawler visits the pages you give us like an ordinary visitor and respects reasonable rate limits. You are responsible for making sure your testing is allowed under any terms that apply to those pages.

You agree not to:

• submit unlawful, infringing, deceptive, hateful or sexually explicit content, or content involving minors;
• use the Service to profile, identify or target real individuals, or to design ads that discriminate unlawfully or target sensitive characteristics (such as health, religion, politics, ethnicity or sexuality);
• probe, overload, scrape or reverse-engineer the Service, bypass usage limits or access other customers' data;
• resell or provide the Service to third parties without our written agreement (agencies may run tests for their own clients);
• present Nivera's simulated results as real campaign data or real people's opinions.

We may suspend or remove content or access that breaks these rules.

Nivera's personas are synthetic and its results are statistical simulations. They can be wrong and do not guarantee any campaign outcome, cost per acquisition, revenue or platform behaviour. Nivera is not affiliated with, endorsed by or using data from Meta, TikTok, Google or any ad platform; references to their products describe what we try to predict. You remain responsible for your marketing decisions and for complying with ad-platform policies and advertising law.

We aim for the Service to be reliable but provide it “as is” and “as available”; maintenance, provider outages or AI model changes may cause interruptions or variations in results. The Service relies on third-party providers (hosting, AI models, payments, sign-in); their failures are outside our control.

To the extent the law allows: (a) we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, ad spend or data; and (b) our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim (or USD 100 if you paid nothing).

Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory local law.

You can stop using the Service and delete your workspaces at any time, and ask us to close your account. We may suspend or end access for serious or repeated breaches of these terms, non-payment, or where required by law. On termination, unused credits lapse unless the law requires a refund, and we delete your data as described in the Privacy Policy.
